Welcome to Dampest Fire Labs LLC. These Terms and Conditions govern your use of our 3D printing, CNC machining, 3D modeling, and related manufacturing services. By engaging our services, you agree to these terms.
1. Services Offered
Dampest Fire Labs LLC provides the following services:
- 3D printing and additive manufacturing
- CNC machining and milling
- 3D modeling and CAD design
- 3D scanning services
- Custom part fabrication
- Prototyping and small-batch production
2. Quotes and Pricing
All quotes are estimates based on the information provided by the client. Final pricing may vary based on:
- Material costs and availability
- Complexity of the design
- Required print time or machining hours
- Post-processing requirements
- Rush orders or expedited services
Quotes are valid for 30 days from the date of issue. We reserve the right to adjust pricing if project specifications change.
3. Payment Terms
- Payment is required before work begins unless otherwise agreed in writing
- For large orders (over $500), a 50% deposit may be required upfront
- Final payment is due upon completion before delivery or pickup
- We accept cash, check, credit cards, and electronic payment methods
- Late payments may incur additional fees
4. File Requirements and Intellectual Property
4.1 Client Files
Clients must provide print-ready 3D model files in compatible formats (STL, OBJ, STEP, etc.). If design services are needed, additional fees will apply.
4.2 Intellectual Property Rights
- You retain all intellectual property rights to your designs and files
- We will not share, reproduce, or distribute your files without explicit permission
- You represent that you own or have the right to use all designs submitted
- You agree to indemnify Dampest Fire Labs LLC against any intellectual property infringement claims
4.3 Prohibited Items
We reserve the right to refuse any project that involves:
- Weapons, weapon components, or items designed to cause harm
- Counterfeit goods or trademark infringement
- Items that violate local, state, or federal laws
- Content that is obscene, defamatory, or offensive
5. Lead Times and Delivery
- Lead times are estimates and not guarantees
- Complex projects may require additional time
- Rush orders may be available for an additional fee
- Delays may occur due to equipment maintenance, material availability, or unforeseen circumstances
- We will communicate any significant delays promptly
6. Quality and Defects
6.1 Quality Standards
We strive to deliver high-quality products. However, 3D printing and CNC machining have inherent limitations:
- Minor layer lines, surface imperfections, or small variations are normal
- Color variations may occur between batches
- Material properties vary and affect final results
6.2 Defects and Remedies
If you receive a defective product:
- Notify us within 7 days of receipt
- Provide photos and detailed description of the issue
- We will assess and, at our discretion, offer a replacement, repair, or refund
- We are not responsible for damage caused by improper use or handling after delivery
7. Cancellations and Refunds
- Before Production: Full refund if cancelled before work begins
- During Production: Partial refund for completed work, materials used, and time invested
- After Completion: No refunds unless the product is defective
- Custom orders cannot be cancelled once production starts
8. Material Limitations and Warranties
3D printed and CNC machined parts have specific material characteristics:
- Parts may not be suitable for high-stress, high-temperature, or outdoor applications unless specified
- We do not warrant parts for specific applications unless agreed in writing
- Client is responsible for determining suitability for intended use
- Material data sheets available upon request
9. Liability Limitations
To the maximum extent permitted by law:
- Our liability is limited to the amount paid for services
- We are not liable for indirect, consequential, or incidental damages
- We are not responsible for injuries or damages resulting from misuse of our products
- Client assumes all risk for use of manufactured parts
10. Privacy and Data Protection
- We respect your privacy and protect your information
- Client files and designs are kept confidential
- We may retain files for quality control and reorder purposes
- We do not sell or share client information with third parties
11. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with the revision date. Continued use of our services constitutes acceptance of modified terms.
12. Governing Law
These Terms and Conditions are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of Erie County, New York.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
